These Terms and Conditions (“Terms”) set the rules for using funfuni.com (the “Site”), operated by Funfuni (“Funfuni”, “we”, “our”, “us”). By using the Site, you accept these Terms. If you do not accept them, please do not use the Site. If you are under 18, go over these Terms with a parent or guardian.

1. About the Site

Funfuni is a free website for playing browser games. Most of the games are made and hosted by independent developers and distributors and are displayed on the Site inside a frame. Access to the Site is free, and we do not sell products, memberships or in-game items.

2. Who may use the Site

Anyone may play games on the Site without registering. You must be at least 13 years old to post a comment or send us personal information.

3. Rules for using the Site

While using the Site, you agree that you will not:

  • post anything abusive, bullying, hateful, sexual, violent, threatening or illegal
  • share personal information about yourself or others, such as full names, addresses, phone numbers, schools or photos
  • post spam, ads or links to other websites
  • pretend to be someone else
  • manipulate ratings or scores or use bots and automated scripts
  • attempt to disrupt, overload, scrape or break into the Site or its systems
  • use the Site in a way that breaks the rules of your school, workplace or network

4. Comments you post

Comments you post remain yours. By posting, you grant Funfuni a non-exclusive, worldwide, royalty-free license to display, reproduce and distribute them on the Site, and you confirm that you have the right to post them. We may edit or remove any comment at any time and for any reason, including comments that break these Terms.

5. Ownership of games and content

The games shown on the Site, along with their titles, logos and artwork, belong to their developers, publishers and other owners. The rest of the Site, including its design, text and selection of games, belongs to Funfuni. You are welcome to play the games and share links to our pages, but you may not copy, download, re-host or resell games or Site content without the owner’s permission.

6. Copyright complaints (DMCA)

Funfuni respects the rights of creators and responds to notices under the Digital Millennium Copyright Act. If you believe something on the Site infringes your copyright, send a notice to [email protected] with “DMCA Notice” as the subject. Your notice should include:

  1. your physical or electronic signature
  2. a description of the copyrighted work you believe is infringed
  3. the URL of the material on the Site
  4. your name, mailing address, phone number and email address
  5. a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act for the owner

When we receive a valid notice, we will remove or disable access to the material. If you believe material was removed by mistake, you may send a counter-notice to the same address. We may block users who repeatedly infringe the rights of others.

7. Third-party games, links and ads

Some games, ads and links on the Site come from third parties. We do not control them and are not responsible for their content, services, chat features or privacy practices, and they may have their own terms. Our Privacy Policy explains more.

8. No warranties

THE SITE AND ALL GAMES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE OR ANY GAME WILL BE AVAILABLE, UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.

9. Limits on our liability

TO THE MAXIMUM EXTENT ALLOWED BY LAW, FUNFUNI IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA OR PROFITS, RESULTING FROM YOUR USE OF THE SITE OR ANY GAME. BECAUSE THE SITE IS FREE, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US$100). SOME STATES DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.

10. Indemnification

To the extent allowed by law, you agree to indemnify and hold Funfuni harmless from any claims, losses and expenses, including reasonable attorneys’ fees, that result from content you post or from your breaking these Terms.

11. Changes to the Site and these Terms

We may change, pause or discontinue any part of the Site at any time. We may also update these Terms; the date at the top shows the current version. If you keep using the Site after an update, you accept the updated Terms. We may limit or end your access to the Site if you break these Terms.

12. General terms

These Terms are governed by the laws of the United States and of the state in which Funfuni is established, without regard to conflict-of-law principles. If any part of these Terms cannot be enforced, the remaining parts stay in effect. If we do not enforce a provision, that does not mean we give up the right to enforce it later. These Terms and our Privacy Policy make up the entire agreement between you and Funfuni about the Site.
